Didactic Med is an independent medical education platform operated by Ernesto Frometa. Didactic Med is not affiliated with, endorsed by, sponsored by, licensed by, or in any way officially connected with any of the trademark holders, professional organizations, certifying bodies, academic institutions, pharmaceutical companies, or standards-setting organizations listed below, unless expressly stated otherwise.

All third-party trademarks, service marks, trade names, product names, logos, and brand identifiers referenced on this platform are used exclusively to identify the source of clinical guidelines, scoring systems, classification frameworks, and professional standards for educational purposes. Such use does not imply any affiliation, endorsement, approval, or sponsorship by the respective trademark holders.

Nominative Fair Use & Educational Purpose Statement

Didactic Med's use of third-party trademarks is made under the doctrine of nominative fair use as established in New Kids on the Block v. News America Publishing, Inc., 971 F.2d 302 (9th Cir. 1992), and analogous fair use and likelihood-of-confusion principles recognized in the United States Court of Appeals for the Eleventh Circuit and other applicable federal circuits, including the traditional multi-factor likelihood-of-confusion analysis applied in the Eleventh Circuit (see Frehling Enters., Inc. v. Int'l Select Group, Inc., 192 F.3d 1330 (11th Cir. 1999)). Specifically:

  1. The referenced clinical scoring systems, guidelines, and classification frameworks cannot be readily identified without use of their trademarked names. There is no commonly accepted alternative designation for instruments such as the Glasgow Coma Scale, the Wells Criteria, or the SOFA Score.
  2. Didactic Med uses only so much of each mark as is reasonably necessary to identify the referenced clinical concept for educational purposes. Marks are used in plain text without reproducing logos, trade dress, or distinctive visual branding elements of the mark holders.
  3. Didactic Med does nothing that would suggest sponsorship or endorsement by any trademark holder. This Trademark Notices page, together with disclaimers within individual tools, expressly negates any implication of affiliation.

Additionally, Didactic Med's use of these marks falls within the scope of educational fair use under 17 U.S.C. § 107 of the Copyright Act, as the platform's purpose is transformative educational commentary and clinical teaching, not reproduction or distribution of the original trademarked works.
